Welcome to Phonezilla (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website located at https://phonezilla.in/ (the “Website”) and all related services, including ordering products (“Products”), customer support and other features (collectively, the “Service”). By accessing or using the Website or placing an Order, you agree to these Terms. If you do not agree, please do not use our Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms used in these Terms have the meaning given in Section 1.2. The singular includes the plural and vice versa. References to “including” mean “including without limitation”.

1.2 Definitions

You means the individual or legal entity who uses the Service or places an Order on the Website.
Product means any item listed for sale on the Website, including but not limited to phone covers, accessories, gadgets.
Order means Your request to purchase Products via the Website, accepted by us in accordance with these Terms.
User Content means any content submitted by You via the Website (like reviews, comments, ratings, images).

2. Acknowledgement

By placing an Order or using the Website, You represent that:

You are at least 18 years old, or have legal capacity in Your jurisdiction to enter binding contracts;
You have read and understood these Terms and will comply with them;
If You are using the Service on behalf of a company or other legal entity, You have authority to bind it to these Terms.

3. Orders, Pricing & Payment

Prices for Products are as listed on the Website in Indian Rupees (₹), inclusive of applicable GST (unless otherwise stated).
We reserve the right to change prices at any time before we accept Your Order.
Your Order is only accepted when we send an Order confirmation (by email or through the Website). We may refuse or cancel any Order for reasons including product unavailability, errors in pricing or description.
Payment must be made using any of the payment methods provided on the Website (credit/debit card, net banking, UPI, or other). We may require payment in advance before dispatch.

4. Delivery & Risk

We will deliver Products to the address you specify in Your Order.
Delivery times are estimates only. While we attempt to meet delivery estimates, delays may occur and we are not liable for any loss or damage due to delay.
Risk of loss and damage to Products passes to You when the Product is delivered at the delivery address. It is Your responsibility to inspect the Product upon delivery.

5. Returns, Exchanges & Warranty

Return / Exchange Window: You may request a return or exchange of Products within 3 days from the date of delivery, subject to the conditions below.
Eligibility: Returns / exchanges are valid only if the Product is unused, with original tags, packaging, accessories and invoice. Products that are damaged due to Your misuse, alteration, or lack of reasonable care will not be accepted.
Defective / Damaged / Wrong Item: If the Product is defective, damaged in transit, or different from what You ordered, please inform us within 24 hours of delivery. We will arrange for return or exchange at no extra cost upon verification.
Refunds: Once we receive the returned Product and verify the condition, we will process the refund to the original payment method within 5‑7 business days. Shipping charges (if any) may only be refunded in cases of defect, wrong item or damage during transit.
Warranty: All Products come with the manufacturer’s warranty (if any). Warranty claims are valid only with proof of purchase (invoice) and subject to the manufacturer’s own warranty policy.

6. User Content

You retain ownership of any content that You upload, post, or otherwise submit to the Service (“User Content”). By submitting User Content, You grant us a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, adapt, publish, translate and distribute such content for our business purposes (e.g. on the Website, in marketing, etc.).
You represent and warrant that User Content is Your own, or that You have all rights needed, and that it does not violate any law or infringe any third-party rights.
We may remove or disable access to User Content that violates these Terms or that we believe in our discretion to be objectionable.

7. Intellectual Property

All rights, title and interest in the Website, the Service, and all content (excluding User Content) are owned by or licensed to Phonezilla. This includes intellectual property such as trademarks, logos, designs, trade dress, software, graphics, text, audio, video, etc. You may not copy, adapt, distribute, or create derivative works without our prior written permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

We are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits, data, business, or goodwill, arising out of or in connection with your use (or inability to use) the Service or Products.
Our total liability arising from any claim related to these Terms or Products shall not exceed the amount You paid for the relevant Product(s).
Nothing in these Terms limits liability which cannot legally be limited under applicable law.

9. Disclaimer of Warranties

The Service and Products are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory. We do not warrant that:

Your use of the Service will be uninterrupted or error‑free;
The Products will always meet your expectations, including quality, design or compatibility with your needs;
All information on the Website (product descriptions, prices, images, etc.) is accurate, complete or up to date.

10. Prohibited Activities

You agree not to engage in the following:

Using the Service for any illegal purpose, or in violation of local, state, national or international law;
Interfering with or disrupting the security, integrity or performance of the Website or related networks;
Attempting to gain unauthorized access to other user accounts, systems, or networks;
Uploading or posting malicious software, viruses, spam, or any content that is harmful, defamatory, obscene, infringing or otherwise illegal;
Misrepresenting your identity or affiliation, or impersonating others.

11. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. On termination, your rights under these Terms cease, but certain clauses (for example Intellectual Property, Limitation of Liability, Governing Law) will continue to apply.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal.
If a dispute arises, we request that you contact us first so we may try to resolve it informally before resorting to litigation.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice via the Website (or by email if we have your address) before the changes take effect. Your continued use of the Service after the changes constitutes acceptance of the revised Terms.

14. Severability & Waiver

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be modified to the extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
No waiver of any term shall be deemed a waiver of any other term, nor shall any waiver constitute a continuing waiver.
